Practical Advice for Real Estate Attorneys

In this well-received program, Mr. Borkowsky discusses the perils and pitfalls facing real estate practitioners in a practice area that, historically, has given rise to the largest number of grievance complaints.

Conflicts of Interest

No other issue within the disciplinary field is as vexing and nuanced as those involving allegations of a conflict of interest. The examples are numerous, and the distinctions subtle.  In this program, Mr. Borkowsky discusses what to look out for and what to do to ensure you remain free from conflicts of interest in your representation of clients.

Reporting Misconduct and Threats

Notwithstanding clarion calls to adhere to the Standards of Civility and our best intentions, lawyers in the throes of litigation or contract negotiations frequently ask whether their adversary’s conduct warrants referral to the disciplinary authorities.  In this program, Mr. Borkowsky discusses the current state of affairs with respect to reporting misconduct of another attorney and provides concrete examples gleaned from real complaints to the Grievance Committee.

The Grievance Process

The Appellate Divisions of the four judicial departments throughout the state are vested with jurisdiction over the conduct and licensing of attorneys. Investigations of complaints of professional misconduct are assigned to the court-appointed grievance committees. Many practitioners, however, are unfamiliar with the disciplinary process.
